These Terms of Service ("Terms") govern your use of the website located at aquafeelcarolina.com (the "Site") and any water treatment equipment or installation services you purchase from Aquafeel Solutions Carolina ("Aquafeel," "we," "our," or "us"). By using the Site or purchasing our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. About Aquafeel Solutions Carolina

Aquafeel Solutions Carolina is a veteran-owned water treatment company based in Wake Forest, North Carolina, serving residential and commercial customers throughout North Carolina and South Carolina. We install and service water softeners, whole-house filtration systems, reverse osmosis systems, and related water treatment equipment.

2. Use of the Website

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law.
  • Transmit unsolicited commercial communications or spam.
  • Attempt to gain unauthorized access to any part of the Site or our systems.
  • Scrape, crawl, or systematically download Site content without our written permission.
  • Introduce malware, viruses, or other malicious code.

We reserve the right to terminate access to the Site for any user who violates these Terms.

3. Free In-Home Water Test

When you request a free in-home water test, you are scheduling a visit by an Aquafeel technician to your property. The water test is provided at no charge and carries no purchase obligation. Test results are for informational purposes only and do not constitute a guarantee or warranty about your water quality or any treatment outcome. Results may vary based on local water conditions, plumbing, and seasonal factors.

4. Equipment and Installation Services

4a. Quotes and Pricing

All price quotes provided verbally, by email, or through the Site are estimates valid for 30 days from the date issued, unless otherwise noted. Final pricing is confirmed in your written service agreement before installation begins. Aquafeel does not display binding prices on the Site; all pricing is individualized based on your water test results, property configuration, and selected equipment.

4b. Service Agreement

All equipment purchases and installations are governed by a separate written service agreement signed by both parties before work begins. In the event of any conflict between these Terms and your signed service agreement, the service agreement controls.

4c. Installation

Installation is performed by Aquafeel technicians or authorized subcontractors. You agree to provide safe and reasonable access to your property and plumbing during the scheduled installation window. You represent that you have the legal authority to authorize modifications to the plumbing at the service address. Aquafeel is not responsible for pre-existing plumbing defects, code violations, or conditions that were not disclosed or reasonably discoverable at the time of the in-home consultation.

4d. Payment

Payment terms are set out in your service agreement. Aquafeel accepts cash, check, and major credit cards. Financing may be available through third-party lenders; Aquafeel is not a lender and is not responsible for the terms, conditions, or decisions of any financing partner.

4e. Cancellation

You may cancel a scheduled water test or consultation at any time before the appointment without penalty by calling (984) 212-3558 or emailing info@aquafeelcarolina.com. Cancellation of an executed service agreement after installation has begun is subject to the cancellation terms in that agreement. North Carolina law provides a 3-business-day right of rescission for certain in-home sales contracts. If your transaction qualifies, we will provide the required cancellation notice form at the time of signing.

5. Warranty

Aquafeel offers a 25-year warranty on equipment we install, subject to the terms and conditions set out on our Warranty page and in your service agreement. The warranty is non-transferable unless otherwise stated in writing. Nothing in these Terms limits or expands the warranty beyond what is stated in your service agreement.

6. Intellectual Property

All content on the Site, including text, photographs, graphics, logos, and software, is the property of Aquafeel Solutions Carolina or its licensors and is protected by United States copyright and trademark law. You may view and print pages from the Site for your personal, non-commercial use only. Any other use, including reproduction, modification, distribution, or republication, requires our prior written consent.

7. Third-Party Links and Services

The Site may contain links to third-party websites (for example, financing partners or manufacturer sites). These links are provided for convenience only. Aquafeel does not control, endorse, or assume responsibility for any third-party website or its content, privacy practices, or products.

8. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, AQUAFEEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

This disclaimer applies to the Site and its informational content only. It does not limit the equipment warranty provided under your signed service agreement.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AQUAFEEL, ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT IN CONNECTION WITH INSTALLED EQUIPMENT OR SERVICES.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aquafeel and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site that is not resolved informally shall be submitted to the exclusive jurisdiction of the state or federal courts located in Wake County, North Carolina. You and Aquafeel each consent to personal jurisdiction in those courts.

Disputes arising out of your service agreement (as opposed to Site use) are governed by the dispute-resolution terms in that agreement, which may differ from this section.

12. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top of this page reflects the most recent revision. Continued use of the Site after a revision constitutes your acceptance of the updated Terms. If the changes are material, we will make a reasonable effort to notify you (for example, by posting a notice on the Site).
